Class
I Convictions - 4 Points Each – add 1 if conviction occurs in
a CMV.
Driving
while under the influence of alcohol, narcotics or illegal
drugs – Employee will be disqualified from driving a Manatt
vehicle for one year from date of conviction - If violation
occurs while driving a Manatt vehicle requiring a CDL, the
employee will be permanently disqualified from driving any
Manatt vehicle.
Driving
after revocation or suspension of license.
Attempting
to elude an officer.
Hit
and run, leaving the scene of an accident, or failure to
report an accident.
Reckless
driving.
Class
II Convictions – 2 Points Each – Add 1 if conviction occurs
in a CMV.
Failure
to keep vehicle under control.
Failure
to yield right of way.
Defective
brakes.
Careless
driving.
Serious
speeding – 20 MPH over - 15 MPH over in CMV.
Driving
too fast for conditions.
Failure
to stop for school bus.
Serious
violations.
Class
III Convictions – 1 Point Each – Add 1 if conviction occurs
in a CMV.
All
other moving violations.
Class
IV Convictions – 1 Point Each.
All
safety violations.
Points
will be multiplied by the following factors, using date of MVR
request as a starting point. (Class IV not included in
multiplier.)
0
to 12 months – times three
>12
to 24 months – times two
>24
to 60 months – times one
Avoidable
Accidents Resulting in a Class I, II, or III conviction. Add
following points to above total.
Personal
injury – 3 points
No
injury – 1 point
Maximum
Points Allowed is 15.
Upon
reaching 12 points drivers will be reevaluated.
Upon
reaching 16 points drivers will be disqualified from driving a
Manatt vehicle until their points diminish to 11 or less.
Drivers
may be allowed to work in a different job position at the
discretion of management, if an opening exists. Rate of pay will
be based on the pay for that job position.
This
policy will go into effect January 1, 2003. Any points acquired
previous to January 1, 2002, will not be counted. Any points
acquired between January 1, 2002, and January 1, 2003, will be
counted but not multiplied by the above factors.
Any
person who loses their right to drive under this policy will
have the right to appeal to Management.
